A source has confirmed that, 'There were two witnesses with Lindsay in the store who are going to tell her side of the story. Her assistant Eleanor and her friend Patrick were with her and they saw everything and they both know that Lindsay didn't steal the necklace.'
It has emerged that the store told Miss Lohan that she could take the necklace but were angered at the fact that she did not get them publicity, which lead to the theft allegation.
The insider also stated, 'She didn't steal the necklace and her eyewitnesses will tell the truth.'
That day it has also been reported that Lindsay had over $6,000 in her possession when visiting the lavish boutique, with the intention of purchasing another item.
An additional source claimed that, 'Lindsay had around $6,000 in cash with her because she had been eyeing a ring in the store, which was going for $3,400. Lindsay had gone to the store several times previously, debating whether to buy it.'
At the beginning of the year, Lindsay was released fron a 90 day court-ordered rehab programme, which was her 5th visit to the facility. Currently she is on probation until her court hearing on February 24th. With the witnesses in mind, it is now doubtful that she will be charged, however if she is, she will be in breach of her probational terms, and unfortunately have to return to jail.
